Terms and Conditions

DEFINITIONS

1.“Buyer” means the individual or organisation that buys or agrees to buy goods from the Seller for the purpose of their business, trade or profession.
2. “Contract “ means a the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions
3. “Goods means the articles the Buyer agrees to buy from the Seller
4. “Seller” means DCI Designer Jewellery
5. “Terms and Conditions” means the terms and conditions of sale set below.

CONDITIONS

1. Nothing in these terms and conditions shall affect the Buyers statutory rights.
2. These terms and conditions shall apply to all contracts for sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the buyer.
3. Acceptance of delivery of Goods shall be deemed as conclusive evidence of the Buyers acceptance of these terms and conditions.
4. Any variation of these Terms and Conditions (including and special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the seller.

PLACING AN ORDER

1. All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to these terms and conditions and are subject to acceptance by the seller. The Seller may choose not to accept an order for any reason.
2. Where goods ordered by the buyer are not available from stock the buyer will be notified accordingly and given the option to either place the items on forward order or receive a full refund.


PAYMENT

1. The price of the Goods shall be that stipulated on the Seller’s Website. The price is exclusive of Postage and Packing and VAT.

2. The total purchase price, including VAT and shipping charges if any will be displayed in the Buyers basket at checkout.

3. The Seller’s minimum order values are as follows:
United Kingdom £75.00 + £4.95 Shipping (Free delivery on orders over £140.00)
European Countries outside UK £140.00 + £15.00 Shipping (Free delivery on orders over £400.00)
Other Countries £400.00 + £25.00 Shipping
The above amounts are net amounts before VAT.

4. Payment for goods must be received before despatch.

5. The Seller accepts online payment for orders by Credit/Debit Card, Paypal, or Bank Transfer. The Seller reserves the right to refuse payment by one or more of these payment methods by the Buyer.

6. In respect of Buyers paying by Bank Transfer, payment must be made to the Sellers Account. (Bank details can be obtained upon request). Cleared funds must be received by the Seller before goods are despatched to the Buyer. Charges in respect of Bank transfers are the responsibility of the Buyer.

7. All payments are to be made by the buyer in Pounds Sterling.
8. Credit card information for the purpose of making a payment on our website is processed by Worldpay (part of the royal bank of Scotland) or Paypal (if this option is chosen).
9. Goods purchased by Credit/Debit Card will only be despatched by the Seller to the registered address of the Credit Card Holder.
10. Buyers from outside the EEC will be exempt from VAT at the prevailing rate providing goods are despatched direct from the Seller to the Country concerned.

11. Buyers operating within the EEC will be exempt from VAT providing their order is supported by a valid VAT number. The Seller will check the validity of the VAT Number produced with the Customs and Excise Authority in the UK, and will only refund any VAT paid if they are satisfied with the information given.

RIGHTS OF SELLER

1. The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.
2. The Seller reserves the right to withdraw any goods from the Website at anytime.
3. The Seller shall not be liable to anyone for withdrawing any goods from the Website or for refusing to process an order.

DELIVERY

1. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery time.
2. Delivery of the Goods shall be made to the Buyers address specified in the order and the Buyer shall make all arrangements necessary to take delivery of Goods upon arrival.
3. In the event of goods being returned to the Seller due to non-delivery, the Buyer will be advised. Redelivery costs will be the responsibility of the Buyer.
4. The title and risk in the goods shall pass to the Buyer upon delivery and the Seller will not be liable for their loss or destruction from this point on.
5. Due to certain insurance limitations the Seller cannot export goods to destinations where local legislation decrees that insurance must be effected locally.

The Seller reserves the right to also exclude other destinations without notice.

SEVERENCE

1. If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provisions eliminated.
